In IM's recent article, Who Died And Made You Man’s Best Friend?, it said about the "vote" on which dog - a Great Dane or Dachshund: This article got me to thinking. Let's look at a much larger and more serious issue. Release date of the game. If Portalarium can't even have an official vote on such a minute and simple feature, what makes anyone think they will do this for game release? Who, in the community, is qualified to call it to a vote? Will Portalarium step forward and say, we'd like you all to vote? If they did, it would mean they believe the game is ready to release, otherwise, why would they ask for a vote? At which point might Portalarium ask for a vote? If they did, would they post it at every login screen, Steam News screen, and newsletter as a main header (not buried somewhere in the newsletter by email), for a period of time? Will they bury it in the forums, where most of us can't even reply, and most players don't even log in? What a convenient excuse to delay launch indefinitely. There is no one to hold them responsible or make them answer. Maybe they are just hoping everyone will get disgruntled enough, sell all their accounts, and they won't have to release a game after all. So then they charge a service fee to sell your account. How far will it all go?

Probably as far as a class-action lawsuit, though I'm no lawyer and so can't speak to the viability of such an option.

There was never a guarantee of the game being released. There are clauses that specifically state this:
For the avoidance of doubt, in consideration of Portalarium’s good faith efforts to develop, produce, and deliver the Game with the funds raised, you agree that any deposit amounts applied against the Game Cost as described above shall be non-refundable regardless of whether or not Portalarium is able to complete and deliver the Game. In the unlikely event that Portalarium is not able to deliver the Game, Portalarium agrees to post an cost accounting on its website to fully explain the use of the deposits for the Game Cost. In consideration of the promises by Portalarium hereunder, you agree to irrevocably waive any claim for refund of any deposit amount that has been used for the Game Cost in accordance with the above.
They could end the game today and no one is owed a single cent.

I would agree with that when applied to donations after the KS ended directly to Papa Port themselves. Do you think it would also apply to the KickStart?

If everyone who sought funds for a wish, and they said, "but we don't have to fulfill your wish, but we have every right to keep asking for your money," I really doubt that could be held up in court. Especially in some countries, and especially when they sought funding through KS. If they did this, and can get away with it, I now understand how so many people can accuse them of scamming. There is no one to hold them accountable to deliver a product. No one.

If that is the entire clause on refunds from their terms, it also leaves wide open holes for getting refunds from other means. I know for a fact I could get a full refund from them, the problem is I don't want to deal with them on that level so even if I have to hold a contest to give away my account I'll be doing that prior to asking for a refund.

It is only sales and profits made for SotA's business model. The senior staff is being paid full salary, while founders/investors in Portalarium are receiving profit % payouts.

I kinda doubt they have made any profit. They are using their funds to keep in production. Shall be interesting to see what happens when the game doesn't make money anymore.

Alright chodeannihilator, this isn't the first time you've made assertions about Port's financial happenings, but every time you're asked to provide evidence, you go silent. So, I ask you, how do you know when or if the crowd-funding phase is over, how do you know the senior staff salaries, and how do you know about special founder handouts?

I completely believe that this is the game.
You don't need millions of dollars to build a game on unity. A licence is not even 100k. Let's get a grip.
Why would you stall production sell crappy add-ons for rediculous prices unless that is the product?
There is no game. This is it.
